Kim Kardashian wins a lawsuit against Missguided USA for copying her outfits and gets $2.7 million in damages!
The celebrity influencer Kim Kardashian has done it again! She has managed to successfully sue the brand Missguided USA for copying the designs of her outfits and received from the $2.7 million as damages!
Kim Kardashian and her lawsuit against fast-fashion brand Missguided USA
Last February, Kim Kardashian, 38 had made a lawsuit against the fast-fashion brand Missguided USA. She accused the brand of using her name and image without her permission. She said that they copied her outfit designs and ripped her of her profits.
Kim shared pictures in the lawsuit of all the outfits which she felt that the fast-fashion brand copied and hence it let to a knock-off of her designs. She asked for $10 million in damages.
In the lawsuit, it was stated that the company has to give up the profits that it obtained unlawfully and unethically. She also requested a permanent injunction in order to stop the company which sells outfits online from future infringements on her outfit designs and the like.
The reason for the lawsuit
The lawsuit was filed in February 2019. This was after Kim found that the online retailer has been using her name and image without her permission to promote and sell their products.
She then tweeted on it. Kim posted a picture of herself in a gold outfit which she said her husband Kanye West made for her summer Miami trip. She tweeted:

The brand Missguided USA at that time responded with a picture of a dress. It seemed to be a copy of Kim’s attire on their Instagram and captioned it:
“The devil works hard but Missguided works harder”.

The verdict of Kim Kardashian’s lawsuit
Last night, Missguided USA did not respond to the lawsuit and hence the California judge passed a default judgment. The judgment read:
“Missguided has repeatedly used Kardashian’s name and likeness. This was without her permission on its social media platforms to promote the sale of its clothing.”
The Judge further said:
“The firm in total disregard of Kardashian’s trademark rights and rights of publicity, have repeatedly used [her] name and image without authorization to generate interest in their brand and website and to elicit sales of their products.”
Kim criticized the brand house and wrote:
“[Missguided] specialises in ‘fast’ and inexpensive clothing designs, which are often derivative of other companies’ designs if not blatant knock-offs. Missguided has become particularly well-known for copying designs worn by famous celebrities. It then offers this for sale on its sites within days – sometimes even hours – of the celebrity appearing in the clothing. Missguided has knocked-off the clothing of other designers. And it has unabashedly misappropriated the rights of celebrities like Kardashian in selling these knock-offs on its websites.”
