On July 25, 2003, he was nominated to the United States Court of Appeals for the District of Columbia Circuit by President George W. Bush.

Brett was one of the potential replacements for Justice Anthony Kennedy and was nominated by President Donald Trump to the Supreme Court.

He was reassigned to the Sixth Circuit and the Eighth Circuit in November 2020. Previously, he was the Seventh Circuit.
