Comey: No Absolute Privacy in America

FBI Director James Comey warned Wednesday that Americans should not have expectations of “absolute privacy,” adding that he planned to finish his term leading the FBI.

“There is no such thing as absolute privacy in America; there is no place outside of judicial reach,”

Comey said at a Boston College conference on cybersecurity. He made the remark when he discussed the increase in encryption since 2013 disclosures by former National Security Agency contractor Edward Snowden which revealed sensitive US spy practices.

“Even our communications with our spouses, with our clergy members, with our attorneys, are not absolutely private in America,”

Comey added.

“In appropriate circumstances, a judge can compel any one of us to testify in court about those very private communications.”

But, he continued to state that Americans “have a reasonable expectation of privacy in our homes, in our cars, in our devices.”

“It is a vital part of being an American. The government cannot invade our privacy without good reason, reviewable in court,”

Comey continued.

It is reported that in the last four months of 2016, the FBI lawfully gained access to 2,800 devices recovered in criminal, terrorism, and counterintelligence investigations and the FBI was unable to open 43% of those devices. Americans’ desire for privacy and security should never be told to be sacrificed, he said.

“We all value privacy, we all value security. We should never have to sacrifice one for the other,”

Comey said.

“Our founders struck a bargain that is at the center of this amazing country of ours and has been for over two centuries.”

Comey’s leadership of the FBI has been controversial in view of the bureau’s handling of the investigation into Hillary Clinton’s email controversy and President Donald Trump’s unfounded accusations that President Barack Obama had ordered the wiretapping of phones at Trump Tower.

He did not talk about the wiretapping claim nor about WikiLeaks’ recent claim that it obtained internal CIA documents.

Comey expressed that he plans to finish out his 10-year tenure.

“You’re stuck with me for about another 6 1/2 years, and so I’d love to be invited back again,”

he said.

Clinton email issue

In July, he announced the FBI’s initial decision to not pursue a case against Clinton, he testified:

“I have been a registered Republican for most of my adult life, not registered any longer. He also called the FBI itself is ‘resolutely apolitical.'”

His longtime friend supported James stating that he was sure that there was no political malice involved with Comey’s decision to re-examine Clinton’s emails.

“When you have an obligation to disclose or to qualify, you do it full-stop. You don’t worry about timing, you don’t worry about how it will be read or spun by others,”

Richman said.

“And in this case, when he learned that what he said to Congress about the review of emails being complete turned out to be dated and requiring correction, he did it. There’s no calculus involved.”

Democrats have severely criticized Comey for his questions about Hillary Clinton’s private email server shortly before the election.

They view this as having pushed things in Trump’s favor. Despite all these, the FBI director is still respected in Washington and seen as an independent voice.

Trump too has publicly complimented Comey when Comey sent a letter to the Congress notifying its members that he was doing an investigation into Clinton’s emails.

“What he did bring back his reputation,”

Trump in late October praised Comey thus:

“It took a lot of guts.”

All this going on entangled the Administration further, which was already struggling to pass the Republicans’ American Health Care Act in a vote in the House of Representatives on Thursday.

The White House moved quickly to spin the hearing and soften its blow. Trump tweeted those sections of the hearing that favored him, including that Comey and Rogers both felt that Russia did not “influence” the electoral process.

Trump Wiretapping Controversy

FBI Director James Comey also was in controversy over President Trump’s claim that he was wiretapped by former President Obama, the New York Times reported.

Officials later stated that Comey has asked the Justice Department to publicly deny Trump’s explosive claim. His reason was that the claim is untrue and also it was implied that the FBI was dealing with illegal behavior.

Comey publicly spoke against Trump’s extraordinary claim that President Obama wiretapped his phone, saying the FBI had “no evidence” of it.

“With respect to the President’s tweets about alleged wiretapping directed at him by the prior Administration, I have no information that supports those tweets and we have looked carefully inside the FBI,”

Comey said.

“The Department of Justice has asked me to share with you that the answer is the same for the Department of Justice and all its components.”

Comey on Russian Officials

Comey said stated explicitly that Vladimir Putin wanted Clinton to lose the election, and Trump to win.

“The hatred for Mrs. Clinton [among Russian officials] was all the way along,”

Comey said.

“When Mr. Trump became the nominee there was some sense that it would be great if he could win, it would be great if we could help him, but we need to hurt her no matter what.”

Comey has limitations on public disclosures about the findings. He announced and confirmed about Russian interference and Trump’s connections to the Russians which was a break from the usual protocol.

FBI doesn’t Deny False Reports

James B Comey does not indulge in any fake news.

“I’ve read a whole lot of stuff, especially in the last two months, that’s just wrong,”

Comey said.

“But I can’t say which is wrong.”

“We’ll give information to our adversaries that way,”

he said. Also:

“We can’t because where do you stop on that slope? ‘Cause then, when I don’t call the New York Times and say, ‘You got that one wrong,’ bingo; they got that one right. So it’s just an enormously complicated endeavor for us. We have to stay clear of it entirely.”

This was in response to questions from Rep. Michael R. Turner (R-Ohio), who also was concerned about the baseless reports.

“What is the obligation of the intelligence community to correct such falsehoods?”

Turner asked.

“We not only have no obligation to correct that; we can’t,”

Comey replied.

“It’s very, very frustrating,”

he added,

“but we can’t start down that road.”
